Medical Malpractice - Case 1
Failure to Diagnose Appendicitis Leads to Emergency
Surgery & 11 Days
in Intensive Care Unit: Client
Sues for Malpractice; Hospital Settles Case Before Trial
We represented the plaintiff in this case for medical malpractice. The plaintiff,
a male, age 50, was admitted to a Phoenix hospital's emergency room complaining
of abdominal
pain and inability to urinate. A foley catheter was placed, antibiotics were
administered, and the plaintiff was instructed to follow up with his family
physician in 48 hours. The diagnosis was urinary tract infection. During
the follow-up visit, the catheter was removed and the plaintiff was instructed
to continue taking the antibiotics. The plaintiff claims that both the hospital
and the family physician incorrectly diagnosed him, because he was actually
suffering from acute appendicitis. The plaintiff's appendix ruptured, and
he was readmitted to the hospital six days later for emergency surgery. Our
client spent 11 days in the intensive care unit following his surgery. The
claim against the hospital was recently settled for an amount which cannot
be disclosed under a confidentiality agreement.
